ভূমি অপরাধ প্রতিরোধ ও প্রতিকার আইন’ মতামতের জন্য প্রকাশিত : ভূমিমন্ত্রী৷ ঢাকা, ২০ জানুয়ারি, ২০২২ (বাসস): ‘ভূমি অপরাধ প্রতিরোধ ও প্রতিকার আইন, ২০২১’র খসড়া সকল অংশীজনের মতামতের জন্য আজ মন্ত্রণালয়ের ওয়েবসাইটে প্রকাশ করা হয়েছে বলে জানিয়েছেন ভূমিমন্ত্রী সাইফুজ্জামান চৌধুরী।
তিনি আজ বৃহস্পতিবার রাজধানীর ওসমানী স্মৃতি মিলনায়তনে অনুষ্ঠিত ‘জেলা প্রশাসক সম্মেলন ২০২২’ এ ভূমি মন্ত্রণালয় সম্পর্কিত কার্য অধিবেশনে প্রধান অতিথি হিসেবে জেলা প্রশাসকদের উদ্দেশে বক্তব্য প্রদানকালে একথা জানান।
মন্ত্রিপরিষদ সচিব খন্দকার আনোয়ারুল ইসলামের সভাপতিত্বে অনুষ্ঠিত ভূমি মন্ত্রণালয় সংশ্লিষ্ট কার্য অধিবেশনে ভূমি সচিব মো. মোস্তাফিজুর রহমান এবং ভূমি সংস্কার বোর্ডের সদস্য সোলেমান খানসহ মন্ত্রিপরিষদ বিভাগ এবং ভূমি মন্ত্রণালয় ও তার আওতাধীন দপ্তরসমূহের ঊর্ধ্বতন কর্মকর্তারা উপস্থিত ছিলেন। খবর সংবাদ বিজ্ঞপ্তির।
সাইফুজ্জামান চৌধুরী বলেন, অবৈধ ভূমি দখলকে ফৌজদারি অপরাধের আওতায় এনে ‘ভূমি অপরাধ প্রতিরোধ ও প্রতিকার আইন, ২০২১’র খসড়া প্রস্তুত করা হয়েছে।
ভূমি দস্যুতা রোধে এই আইন কার্যকর ভূমিকা রাখবে বলে উল্লেখ করে ভূমিমন্ত্রী আরও বলেন, কৃষিজমি সুরক্ষা, খাদ্য নিরাপত্তা, জলবায়ু পরিবর্তনের ক্ষতিকর প্রভাব হ্রাসের উদ্দেশ্যে করা ‘ভূমি ব্যবহার আইন ২০২১’র খসড়া তৈরিও প্রায় শেষের দিকে রয়েছে।
ভূমিমন্ত্রী এ সময় জেলা প্রশাসকদের খাস জমি উদ্ধার এবং খাদ্য নিরাপত্তায় তিন ফসলী জমির সুরক্ষা নিশ্চিত করার জন্য নির্দেশ দেন।
এ সময় তিনি এক স্থানে বিভিন্ন দপ্তরের জন্য ঊর্ধ্বমুখী সমন্বিত সরকারি অফিস করার ব্যাপারে প্রধানমন্ত্রীর অনুশাসনটিও পুনর্ব্যক্ত করেন।
সাইফুজ্জামান চৌধুরী আরও বলেন, ভূমি অধিগ্রহণ মামলায় (এলএ কেস) মোক্তারনামা (পাওয়ার অব এটর্নি) ব্যবস্থা বাতিল করার ব্যাপারটি বিবেচনাধীন আছে।
তিনি বলেন, অধিগ্রহণ প্রক্রিয়া ও ক্ষতিপূরণ প্রদানের সময় পাওয়ার অব এটর্নির মাধ্যমে ব্যাপক দুর্নীতি হয়। বিশেষ করে গ্রামাঞ্চলের সাধারণ মানুষ এটার মাধ্যমে অসাধু ব্যক্তির দ্বারা প্রতিনিয়ত প্রতারণা ও হয়রানির শিকার হচ্ছেন। এজন্য বিশেষ ক্ষেত্র ব্যতীত, সাধারণভাবে এলএ কেসে পাওয়ার অব এটর্নি বন্ধ করার বিষয়টি বিবেচনাধীন আছে।
মন্ত্রী বলেন, বিদেশে বসবাসরত ব্যক্তিরা বাংলাদেশ দূতাবাসের মাধ্যমে পাওয়ার অব এটর্নি দিতে পারবেন। গুরুতর অসুস্থ ব্যক্তির ক্ষেত্রে এবং অন্যান্য প্রযোজ্য ক্ষেত্রে সংশ্লিষ্ট জেলা প্রশাসকের কাছে আবেদন করেও পাওয়ার অব এটর্নি দেওয়া যাবে।
সকলের মতামতের ভিত্তিতেই এই বিষয়ে চূড়ান্ত সিদ্ধান্ত নেওয়া হবে বলেও জানান ভূমিমন্ত্রী।
সাইফুজ্জামান চৌধুরী জানান, ভূমিসেবা আরও সহজ করতে ই-রেজিস্ট্রেশন এবং ই-মিউটেশনের ইন্টিগ্রেশনের উদ্যোগ নেওয়া হয়েছে। এতে জমির হাতবদলে স্বয়ংক্রিয়ভাবে নামজারি হয়ে যাবে। এছাড়াও অত্যাধুনিক প্রযুক্তির সাহায্যে বাংলাদেশ ডিজিটাল সার্ভে (বিডিএস) দ্রুত শুরু করা হবে।
বিডিএস বাংলাদেশের সর্বশেষ ‘ক্যাডাস্ট্রাল জরিপ’ হবে বলে উল্লেখ করে মন্ত্রী বলেন, বিডিএস বাস্তবায়িত হলে জমি হাত বদলে স্বয়ংক্রিয়ভাবে খতিয়ান ও ম্যাপ প্রস্তুত হয়ে যাবে। যুগ যুগ ধরে জরিপের হয়রানি থেকে দেশের মানুষ রক্ষা পাবে।
অধিবেশনে জেলা প্রশাসকগণ বিভিন্ন বিষয়ে তাদের মতামত ব্যক্ত করেন। খাসজমি, নামজারি, হাট ও বাজার, ভূমি অফিস নির্মাণ, জলমহাল, পার্বত্য অঞ্চলের ভূমি ব্যবস্থাপনা, কোর্ট অব ওয়ার্ডস, ভূমি সংশ্লিষ্ট জনবল ও প্রশিক্ষণ, ডিজিটালাইজেশন, ভূমি ব্যবস্থাপনায় উদ্ভাবনসহ ভূমি সংক্রান্ত নানা বিষয় নিয়ে কার্য অধিবেশনের আলোচনা করা হয়।
জেলা প্রশাসক ভূমি রেজিস্ট্রেশন ও ভূমি জরিপ ব্যতীত, ভূমি রাজস্ব ও ভূমি ব্যবস্থাপনাসহ ভূমি সংক্রান্ত অন্যান্য সকল সেবা প্রদানে কালেক্টর হিসেবে জেলা পর্যায়ে দায়িত্বপ্রাপ্ত কর্মকর্তা হিসেবে দায়িত্ব পালন করে থাকেন।
Dhaka, Jan 20, 2022 (BSS): The draft Land Crime Prevention and Remedy Act, 2021 has been published on the ministry’s website today for the opinion of all stakeholders, said Land Minister Saifuzzaman Chowdhury.
He said this while addressing the Deputy Commissioners as the chief guest at the working session on land ministry at the ‘Deputy Commissioners Conference 2022’ held at Osmani Memorial Auditorium in the capital on Thursday.
Cabinet Secretary Khandaker Anwarul Islam chaired the working session of the Ministry of Land. Mostafizur Rahman and Soleman Khan, a member of the Land Reforms Board, along with senior officials from the Cabinet Division and the Ministry of Land and its subordinate departments were present. Saifuzzaman Chowdhury said that the draft of ‘Land Crime Prevention and Remedy Act, 2021’ has been prepared by bringing illegal land grabbing under criminal offenses.
Mentioning that this law will play an effective role in preventing land piracy, the land minister further said that the drafting of ‘Land Use Act 2021’ aimed at protection of agricultural land, food security, mitigation of adverse effects of climate change is also nearing completion.
The land minister directed the deputy commissioners to recover khas land and ensure protection of three crop lands in food security.
He also reiterated the Prime Minister’s directive to set up an integrated government office for various departments in one place.
Saifuzzaman Chowdhury further said that in the case of Land Acquisition (LA case) the matter of revocation of power of attorney is under consideration.
He said there was widespread corruption in the acquisition process and in the payment of compensation through the power of attorney. Ordinary people, especially in rural areas, are constantly being deceived and harassed by dishonest people. Therefore, except in special cases, the issue of closing the power of attorney in the LA case in general is under consideration.
The Minister said that persons residing abroad will be able to file power of attorney through Bangladesh Embassy. Power of Attorney can also be given in case of seriously ill person and in other applicable cases by applying to the concerned Deputy Commissioner.
The final decision will be taken on the basis of everyone’s opinion, said the land minister.
Saifuzzaman Chowdhury said that initiatives have been taken for the integration of e-registration and e-mutation to make land service easier. This will automatically change the name of the land. Besides, Bangladesh Digital Survey (BDS) will be launched soon with the help of latest technology.
Mentioning that BDS will be the latest ‘cadastral survey’ of Bangladesh, the minister said that if BDS is implemented, ledgers and maps will be prepared automatically. The people of the country will be protected from the harassment of surveys for ages.
During the session, the Deputy Commissioners expressed their views on various issues. The working session discussed various issues related to land including khas land, namjari, hat and bazaar, construction of land office, jalmahal, land management in hilly areas, courts of wards, land related manpower and training, digitization, innovation in land management.
Apart from land registration and land survey, the Deputy Commissioner is the Collector in charge of all other services related to land including land revenue and land management.
