আইন সাধারণ অর্থে আইন হলো মানুষের চলাফেরার ক্ষেত্রে আবশ্যক কিছু নিয়মকানুন। ‘আইন’ হলো একটি  ফারসি বা পারসিয়ান শব্দ এবং বিশেষ্য। ‘আইন’ শব্দটির আভিধানিক অর্থ হলো- সরকারি বিধি; বিধান; কানুন; নিয়মাবলি যা দেশের সমস্ত মানুষ মেনে চলে বা মানতে বাধ্য। ফারসি শব্দ থেকে আগত এবং বাংল অভিধানে ঠাঁই পাওয়া ‘আইন’ শব্দের ইংরেজি প্রতিশব্দ হলো ল (Law)। এই ল (Law) শব্দের আগমন ঘটেছে  ল্যাগ (Lag) নামক অন্য এক শব্দ থেকে, যার আভিধানিক অর্থ হলো স্থির ও অপরিবর্তনীয় যা সবার ক্ষেত্রে সমানভানে প্রযোজ্য।

আইনের সংজ্ঞা

আইন প্রসঙ্গে উইকিপিডিয়ার বাংলা সংস্করণে একটি সাধারণ সংজ্ঞার উল্লেখ রয়েছে, সেটি হলো- “মানুষকে সুষ্ঠু, স্বাধীন এবং সুশৃংখলভাবে পরিচালনার জন্য যে নিয়ম-কানুন তৈরি করা হয় তাকে আইন বলে”। রাষ্ট্রবিজ্ঞানের ভাষায় আইন হলো সার্বভৌম শক্তি কর্তৃক বলবৎযোগ্য বিধান, যা সকলের জন্য অবশ্য পালনীয়।

আইন হলো এমন কিছু কঠোর নিয়ম বা রীতির সমষ্টি যাকে নাগরিক বাধ্যতা, রাজনীতি, অর্থনীতি এবং সমাজের ভিত্তি নির্মাণ করতে ও প্রতিষ্ঠানের মাধ্যমে কার্যকরী করতে  হাতিয়ার হিসেবে ব্যবহার করা হয়। আইন লিখিত হয়। তবে কখনো কখনো প্রচলিত বিধি-বিধানকেও আইন হিসেবে গণ্য করা হয়। অবশ্য অলিখিত আইন মানার জন্য সরকারিভাবে বা প্রাতিষ্ঠানিকভাবে কাউকে বাধ্য করা যায় না; কিন্তু সামাজিকভাবে চাপ প্রয়োগ করা যেতে পারে।

৩৫০ খ্রিস্টপূর্বাব্দে গ্রিক দার্শনিক অ্যারিস্টটল বলেন, “আইন হলো পক্ষপাতহীন যুক্তি।” অ্যারিস্টটল আইন প্রসঙ্গে আরও লিখেছিলেন, “আইনের শাসন যেকোন ব্যক্তি শাসনের চেয়ে ভালো।”

আইনবিদ জন অস্টিনের মতে, “সার্বভৌম শক্তির আদেশই হলো আইন।” 

অধ্যাপক হল্যান্ড-এর মতে, “আইন হলো মানুষের বাহ্যিক আচরণ নিয়ন্ত্রণের এমন কতগুলো সাধারণ নিয়ম যা সার্বভৌম রাজনৈতিক কর্তৃত্ব দ্বারা প্রযুক্ত হয়।” 

স্যার হেনরি মেইন বলেন, “আইন হলো পরিবর্তনশীল, ক্রমাউন্নতিমূলক, ক্রমবর্ধমান ও দীর্ঘকালীন সামাজিক প্রথার গতির ফল।” 

আইনের সার্বজনীন ও উৎকৃষ্ট সংজ্ঞা প্রদান করেছেন মার্কিন যুক্তরাষ্ট্রের প্রেসিডেন্ট উড্রো উইলসন।  উড্রো উইলসন বলেছেন, “আইন হ সমাজের সে সব সুপ্রতিষ্ঠিত প্রথা ও রীতিনীতি যেগুলো সমাজ কর্তৃক স্বীকৃত ও রাষ্ট্র কর্তৃক গৃহীত বিধিতে পরিণত হয়েছে এবং যাদের পিছনে রাষ্ট্রীয় কর্তৃত্বের সুস্পষ্ট সমর্থন রয়েছে।”

আইনের উপর্যুক্ত সংজ্ঞাসমূহ বিশ্লেষণ করলে বলা যেতে পারে, আইন হলো জনগণের বাহ্যিক আচরণ নিয়ন্ত্রণ সংক্রান্ত বিধিবদ্ধ নিয়মাবলি; যা রাষ্ট্র ও সমাজ কর্তৃক গৃহীত, সমর্থিত ও প্রযুক্ত হয়। আমাদের মনে রাখতে হবে যে, একটি দেশের জনগণের কল্যাণের জন্য আইন অত্যাবশ্যক। আইন ভঙ্গ করলে সার্বভৌম কর্তৃপক্ষ প্রয়োজনে বল প্রয়োগ ও শাস্তি প্রদান করে আইন মেনে চলতে বাধ্য করে।

আইনের বৈশিষ্ট্যসমূহ 

নিচে আইনের কিছু বৈশিষ্ট্য উল্লেখ করা হলো: 

  • বিধিবদ্ধ নিয়মাবলি: আইনের গুরুত্বপূর্ণ বৈশিষ্ট্য হ প্রথা, রীতি-নীতি ও নিয়ম-কানুনের সমষ্টি।
  • রাষ্ট্রীয় অনুমোদন ও স্বীকৃতি: আইনের আর একটি অন্যতম বৈশিষ্ট্য হলো বিধি-বিধান প্রচলিত নিয়ম-কানুন বা প্রথাসমূহ যা রাষ্ট্রীয় কর্তৃপক্ষ কর্তৃক অনুমোদন ও স্বীকৃতির প্রয়োজন হয়। আইন হতে হলে রাষ্ট্রীয় কর্তৃপক্ষ কর্তৃক রচিত, অনুমোদিত ও স্বীকৃতিপ্রাপ্ত হতে হবে।
  • সার্বজনীনতা: আইন সার্বজনীন। সকল মানুষই আইনের দৃষ্টিতে সমান। জাতি-ধর্ম, বর্ণ, গোত্র, নারী-পুরুষ, ধনী-গরিব, রাজা-প্রজা নির্বিশেষে সকল মানুষের উপর আইন সমভাবে প্রযোজ্য।
  • সুস্পষ্ট: আইনের বিধানগুলো সুনির্দিষ্ট ও সুস্পষ্ট। সুনির্দিষ্ট কর্তৃপক্ষ কর্তৃক আইন বলবৎ হয়। এ জন্যই আইনের ক্ষেত্রে কোন অস্পষ্টতা থাকে না। 
  • আইন ভঙ্গ করা শাস্তিযোগ্য: কেউ আইন ভঙ্গ করলে শাস্তি পেতে হয়। আইনের ব্যতিক্রম সমাজে বিশৃঙ্খলা সৃষ্টি করে বিধায় আইন অবশ্যই পালনীয়। তাই আইন ভঙ্গ করা শাস্তিযোগ্য অপরাধ। 
  • আইনের স্থান সবার ঊর্ধ্বে: আইন হচ্ছে সার্বভৌম শক্তির আদেশ। তাই সকলেই আইন মেনে চলতেবাধ্য। সার্বভৌম শক্তি কর্তৃক সমর্থিত বিধায় আইনের স্থান সবার ঊর্ধ্বে। 
  • বাহ্যিক আচার আচরণের সাথে যুক্ত: আইন প্রধানত মানুষের বাহ্যিক আচার-আচরণ ও ক্রিয়াকলাপকে নিয়ন্ত্রণ করে। মানুষের চিন্তা ভাবনার সাথে আইনের প্রত্যক্ষ কোন সম্পর্ক নেই।

আইনের উৎসসমূহ 

আইন বিভিন্ন উৎস থেকে সৃষ্টি হয়েছে। অধ্যাপক হল্যান্ডের মতে আইনের উৎস ৬ টি। আইনের উৎসসমূহ নিম্নরূপ:

  1. প্রথা বা রীতিনীতি
  2. ধর্ম
  3. বিচারকের রায়
  4. ন্যায়বিচার
  5. বিজ্ঞানসম্মত আলোচনা
  6. আইনসভা 

নিম্নে আইনের উৎস সম্পর্কে আলোচনা করা হলো:

১. প্রথা বা রীতিনীতি

প্রথা হ আইনের এক সুপ্রাচীন উৎস। প্রত্যেক সমাজেই সুপ্রাচীনকাল থেকে বিভিন্ন প্রকার প্রথা ও রীতিনীতি প্রচলিত। এ সমস্ত প্রথা ও রীতিনীতি সমাজ জীবনের সাথে নিবিড়ভাবে সম্পর্কযুক্ত। সমাজ জীবনের প্রয়োজনীয়তা ও কল্যাণের দিকে দৃষ্টি দিয়ে রাষ্ট্রীয় কর্তৃপক্ষ যখন এগুলোরপ্রতি সমর্থন জানায় তখন এ সব প্রথা ও রীতিনীতি আইনে পরিণত হয়। অতএব এভাবেই সমাজ জীবনে প্রচলিত প্রথা ও রীতিনীতি আইনের উৎস রূপে গণ্য হয়। 

২. ধর্ম

আইনের একটি গুরুত্বপূর্ণ উৎস হলো ধর্ম। বিশ্বে প্রচলিত প্রত্যেক ধর্মের অনুশাসন মর্যাদা সহকারে পালিত হয়ে থাকে। ধর্মীয় এ সমস্ত অনুশাসনের যেগুলো সমাজ জীবনকে বিকশিত ও শৃঙ্খলাবদ্ধ করে থাকে সেগুলো পরবর্তিতে রাষ্ট্রীয় কর্তৃত্বের স্বীকৃতি পেয়ে আইনের মর্যাদা লাভ করে। মুসলিম, খ্রিষ্টীয় ও হিন্দু আইন এর উপযুক্ত উদাহরণ।

৩. বিচারকের রায়

বিচারকগণ অনেক সময় নিজেদের বিবেক ও অভিজ্ঞতা থেকে নতুন আইন সৃষ্টি, প্রচলিত আইনের ব্যাখ্যা বা যথার্থতা বিশ্লেষণ করেন। ফলে আইনের নতুন নতুন সূত্র সৃষ্টি হয়। অন্যান্য বিচারক পরবর্তী সময়ে আইনের এসব নতুন সূত্রকে বিচারের ক্ষেত্রে অনুসরণ করেন। 

৪. ন্যায়বিচার

যুগের পরিবর্তনের সাথে সাথে প্রচলিত আইন যখন অনুপযুক্ত হয়ে পড়ে কিংবা নতুন সমস্যারসমাধান পচ্র লিত আইনের মধ্যে না পাওয়া যায়, তখন বিচারকগণ ন্যায়বিচার নিশ্চিত করার জন্য নিজেদের বিচারবুদ্ধি ও ন্যায়বোধ প্রয়োগ করেন। এভাবে নতুন আইন সৃষ্টি হয় এবং আইন যুগোপযোগী হয়। 

৫. বিজ্ঞানসম্মত আলোচনা

যুগে যুগে আইনজ্ঞদের বিজ্ঞানসম্মত আলোচনা, ব্যাখ্যা ও মতামত বিচারালয়কর্তৃক গৃহীত হয়েছে। এতে আইনের প্রকৃত অর্থের প্রকাশ ঘটে। ফলে আইনজ্ঞদের এসব আলোচনা ও সিদ্ধান্ত আইনের অন্যতম উৎস হিসেবে বিবেচিত হয়।

৬. আইনসভা

আধুনিক রাষ্ট্রে আইনসভাই হচ্ছে আইনের প্রধানতম উৎস। আইনসভা সমাজের প্রয়োজনের সাথে সংগতি রেখে নতুন নতুন আইন তৈরি করে, আইনের রদবদল ও সংশোধন করে থাকে। আইনসভাই হচ্ছে জনপ্রতিনিধিত্বমূলক পরিষদ। তাই আইনসভা জনমতের সাথে সঙ্গতি রেখে আইন প্রণয়ন করে থাকে। সুতরাং আইনসভাই হচ্ছে আইন প্রণয়নের সবচেয়ে গুরুত্বপূর্ণ উৎস। 

এই ছয়টি উৎস ছাড়াও কেউ কেউ জনমতকে আইনের গুরুত্বপূর্ণ উৎস হিসেবে বর্ণনা করেছেন। অপেনহেম বলেন, ‘জনমত আইনের অন্যতম উৎস’। জনমতের প্রভাবে সরকার অনেক আইন তৈরি করে। 

সারসংক্ষেপ 

সমাজ জীবনের প্রচলিত বিধিবিধানগুলো যখন অধিকাংশ মানুষের সমর্থন লাভ করে এবং যা ভঙ্গ করলে শাস্তি হয় তাই আইন। আইন সার্বভৌম কর্তৃপক্ষ কর্তৃক প্রয়োগ করা হয়। আইনের বিভিন্ন বৈশিষ্ট্য হলো- বিধিবদ্ধ নিয়মাবলি, রাষ্ট্রীয় অনুমোদন, সুস্পষ্ট, সার্বজনীন, শাস্তিযোগ্য, আইনের স্থান সবার ঊর্ধ্বে ও বাহ্যিক আচার-আচরণ নিয়ন্ত্রণ। বিভিন্ন উৎস থেকে আইন তৈরি হয়েছে। যেমন- প্রথা বা রীতিনীতি, ধর্ম, বিচারকের রায়, ন্যায় বিচার, বিজ্ঞানসম্মত আলোচনা এবং আইনসভা

In the language of political science, law is a provision enforced by a sovereign power, which must be obeyed by all.

Laws are a set of strict rules or customs that are used as tools to build civil society, politics, economics, and society and to enforce them through institutions. The law is written. However, sometimes the prevailing rules and regulations are also considered as law. Of course, no one can be forced to obey unwritten laws officially or institutionally; But socially pressure can be applied.

In 350 BC, the Greek philosopher Aristotle said, “Law is an impartial argument.” Aristotle also wrote in the context of law, “The rule of law is better than the rule of any individual.”

According to jurist John Austin, “the law is the order of the sovereign power.”

According to Professor Holland, “the law is a set of general rules governing the outward behavior of human beings that are enforced by sovereign political authority.”

Sir Henry Maine said, “Law is the result of a changing, progressive, growing and long-lasting social system.”

US President Woodrow Wilson has given a universal and excellent definition of law. Woodrow Wilson said, “Laws are those well-established customs and traditions of society which have become rules recognized by society and adopted by the state and which have the clear support of the state authorities behind them.”

Analyzing the above definitions of law, it can be said that law is the statutory rules governing the external behavior of the people; Which is accepted, supported and applied by the state and society. We must remember that the law is vital for the welfare of the people of a country. In case of violation of the law, the sovereign authority is required to comply with the law by using force and punishment.

Features of the law
Below are some features of the law:

Statutory Rules: An important feature of law is the set of customs, traditions and rules.
State Approval and Recognition: Another characteristic of the law is the rules and regulations which require approval and recognition by the state authorities. In order for the law to be enacted, it must be written, approved and recognized by the state authorities.
Universality: The law is universal. All people are equal before the law. The law applies equally to all people irrespective of race, religion, caste, tribe, gender, rich and poor, king and subject.
Explicit: The provisions of the law are precise and explicit. The law is enforced by specific authorities. That is why there is no ambiguity in the law.
Breaking the law is punishable: anyone who breaks the law is punished. The law must be obeyed as exceptions to the law create chaos in the society. So breaking the law is a punishable offense.
The place of law is above all: law is the order of sovereign power. So everyone is bound by the law. The place of law is above all because it is supported by the sovereign power.
Associated with external behaviors: Laws primarily regulate the external behaviors and activities of human beings. The law has nothing to do with human thinking.
Sources of law
Laws have been created from different sources. According to Professor Holland, there are six sources of law. The sources of the law are as follows:

The source of the law is discussed below:

  1. Custom or custom
    Practice is one of the oldest sources of law. Different types of customs and rituals have been prevalent in every society since ancient times. All these customs and rituals are closely related to social life. All these customs and traditions become law when the state authorities support them with a view to the necessities and welfare of social life. Therefore in this way the prevailing customs and traditions in the life of the society are considered as the source of law.
  2. Religion
    Religion is an important source of law. Discipline of every religion prevalent in the world is observed with dignity. All these religious disciplines which develop and discipline the social life, later on, after gaining the recognition of state authority, get the status of law. Suitable examples of Muslim, Christian and Hindu law.
  3. Judge’s judgment
    Judges often use their own conscience and experience to create new laws, interpret existing laws, or analyze their validity. As a result, new formulas of law are created. Other judges later followed these new rules of law.
  4. Justice
    Judges use their discretion and fairness to ensure justice when the prevailing law becomes inappropriate with the change of age or new problems are not found in the existing law. Thus new laws are created and laws are up-to-date.
  5. Scientific discussion
    From time immemorial, scientific discussions, interpretations and opinions of jurists have been adopted by the judiciary. This reveals the true meaning of the law. As a result, these discussions and decisions of jurists are considered as one of the sources of law.
