ফৌজদারী মামলা কি?
ব্যক্তি, সমাজ ও রাষ্ট্রের শান্ত-শৃঙ্খলা নষ্ট করার ফলে যে মামলা হয় সেগুলো ফৌজদারী মামলা।
- চুরি, ডাকাতি, ছিনতাই;
- অপহরণ;
- ধর্ষণ;
- মানহানি;
- এসিড নিক্ষেপ;
- যৌতুক দাবী, যৌতুকের জন্য নির্যাতন;
- অবৈধ অস্ত্র সংক্রান্ত অপরাধ;
- মারপিট বা যে কোন শারীরিক আঘাত;
- মানব পাচার
- হত্যা
- আত্নহত্যায় প্র্ররোচনা
- প্রতারণা, জালিয়াতি

ফৌজদারী মামলা কোথায় ও কিভাবে করতে হয়?
আপনি বা আপনার প্রতিবেশীর সাথে ফৌজদারী অপরাধ সংঘটিত হলে যা করতে পারেন-
- ফৌজদারী মামলা করতে চাইলে ঘটনাস্থল যে থানার সীমানার মধ্যে অবস্থিত সেই থানায় এজাহার দাখিল করুন।
- থানায় এজাহার না নিলে কোর্টে নালিশী দরখাস্ত দাখিল করুন।
- মারপিট, জখম, ধর্ষণ বা আঘাতের মামলা দায়েরের জন্য মেডিকেল সার্টিফিকেট সংগ্রহ করুন।
- কেউ হুমকি দিলে বা কোন ব্যক্তি নিখোঁজ হলে নিকটস্থ থানায় সাধারণ ডায়েরী বা জি.ডি.এন্ট্রি’র জন্য দরখাস্ত করুন। ক্ষেত্রবিশেষ জি.ডি থেকে মামলা হয়।
- মামলা দায়ের হলে তদন্ত শুরু হয়। তদন্ত শেষে পুলিশ চার্জশীট অথবা ফাইনাল রিপোর্ট দাখিল করে।
- পুলিশ চার্জশিট দিলে বিচারিক কোর্ট অভিযোগ গ্রহণ করে বিচার কাজ শুরু করেন।
- মামলার যে কোন পর্যায়ে অভিযুক্ত ব্যক্তি জামিনের দরখাস্ত করে জামিন পেতে পারেন।
- বিচার শেষে বিচারিক কোর্ট খালাস অথবা শাস্তির আদেশ দেন।

ফৌজদারী মামলার ক্ষেত্রে জেলা লিগ্যাল এইড অফিস সরকারি খরচে কি কি সহায়তা প্রদান করে?
যাদের বাৎসরিক আয় ১০০,০০০/- ( এক লক্ষ ) টাকার বেশি নয় তারা জেলা লিগ্যাল এইড অফিস থেকে বিনামূল্যে যেসব সহায়তা পাবেন-
- জেলা লিগ্যাল এইড অফিস হতে আইনগত তথ্য ও পরামর্শ;
- প্যানেল আইনজীবীর নিকট হতে আইনগত পরামর্শ;
- সরকারি সহায়তায় ফরিয়াদি/অভিযোগকারী/অভিযুক্ত ব্যক্তির পক্ষে নিয়োগের মাধ্যমে মামলা পরিচালনা;
- আসামী হাজিরার জন্য পত্রিকায় বিজ্ঞপ্তি প্রকাশ;
- প্রয়োজনীয় কাগজপত্র ( যেমন: মেডিকেল সার্টিফিকেট) সংগ্রহ করার বিষয়ে পরামর্শ ও তথ্য প্রাপ্তি;
- কারাগারের আবেদনকারীর ক্ষেত্রে প্রয়োজনীয় নকল পেতে সহায়তা;
- ডি.এন.এ. টেস্ট এর খরচ।
কারাগারে আটক ব্যক্তিদের জন্য সরকারি আইন সহায়তা পাওয়ার উপায় কি?
কারাগারে আটক ব্যক্তিগণের জন্য জেলা কারাগার কর্তৃপক্ষের মাধ্যমে আইন সহায়তার আবেদন করতে হয়।
- যে কোন ধরণের ফৌজদারী মামলায় অভিযুক্ত হাজতী ব্যক্তি জেলা কারাগারের মাধ্যমে লিগ্যাল এইড প্যানেল আইনজীবী নিয়োগের জন্য আবেদন করতে পারেন;
- কারাগার কর্তৃপক্ষ অভিযুক্ত ব্যক্তির নাম, পিতার নাম, হাজতী নম্বর, মামলার নম্বর এবং কোন আইনের অধীন ও কোন আদালতে মামলা এ সকল তথ্য লিগ্যাল এইড অফিসে প্রেরণ করেন;
- প্যানেল আইনজীবী লিগ্যাল এইড অফিসের সহায়তায় এজাহার/নালিশী দরখাস্তের নকল, চালান(ফরোয়াডিং)প্রতিবেদন, পুলিশ রিপোর্ট (খসড়া মানচিত্র, সুচিপত্র, জব্দ তালিকা), মেডিকেল সার্টিফিকেট, পূর্বেকার আদেশের কপি ( মিসকেস এর ক্ষেত্রে) সংগ্রহ করতে পারবেন;
- আটক ব্যক্তির আত্নীয় স্বজন মামলার তদবিরকারী হিসাবে লিগ্যাল এইড অফিস ও প্যানেল আইনজীবীর নিকট থেকে মামলার তথ্য নিতে পারবেন;

What is the way to get government legal aid for the detainees in the jail? The detainees have to apply for legal aid through the district jail authorities.
Detainees accused in any type of criminal case may apply for the appointment of a legal aid panel lawyer through the district jail;
Prison authorities send the name of the accused, father’s name, detention number, case number and all such information to the Legal Aid Office under which law and in which court the case is filed;
The panel lawyer with the help of Legal Aid Office can collect duplicate of statement / complaint application, invoice (forwarding) report, police report (draft map, table of contents, seizure list), medical certificate, copy of previous order (in case of miscalculation);
Relatives of the detainee will be able to obtain case information from the Legal Aid Office and the panel’s lawyer as a case counsel;
