বর্তমানে জমির দাম অনেক বেশি এবং দিন দিন তা হু হু করে বাড়ছে। অনেকেই স্বপ্ন লালন করেন নিজের একটি জমি হবে। কিন্তু আবাসযোগ্য ভালো জমির পরিমাণ অনেক কম এবং পাওয়াও কঠিন।
এজন্য বিভিন্ন প্রতারক চক্র ” ভালো জমি” বিক্রির লোভ দেখান। সহজ সরল মানুষ একটি ভালো জমির মালিক হবার জন্য দ্রুত টাকা পরিশোধ করে রেজিস্ট্রি করে নেন। কিন্তু দখল করতে গিয়ে দেখেন জমিটি ঝামেলাপূর্ণ। এজন্য জমি কেনার আগে জানা উচিত কোন জমিগুলো একদমই কেনা উচিত নয়।

একটা ভালো জমি যেমন আপনার সারা জীবনের একটা সম্বল হতে পারে। ঠিক তেমনি, ভুল জমি ক্রয় আপনার সারা জীবনের কান্নার কারণ হতে পারে।
আসুন জেনে নেই, কোন্ জমিগুলো ভুলেও কেনা উচিত নয়-

১. খাস জমিঃ
জমি কেনার সময় খোজ নিয়ে দেখবে যেন সেটি খাস জমি না হয়। যে জমিগুলো সরাসরি সরকারের মালিকানাধীন থাকে সেগুলোকে খাস জমি বলা হয়। অনেক সময় অনেক প্রতারক জাল দলিল তৈরি করে “খাস জমি” বিক্রি করা হয়।
আইনে বলা আছে, কোনো জমি যদি সরকারের হাতে ন্যস্ত থাকে ও সরকারের নিয়ন্ত্রণাধীন থাকে সেইগুলোই খাস জমি। সরকার এ জমিগুলো বন্দোবস্ত দিতে পারেন। সাধারণত ভূমিহীন ব্যক্তিরা সরকারীভাবে খাস জমি পায়। এজন্য জমি কিনার পূর্বে ভুমি অফিসে খোঁজ নিয়ে দেখুন যে জমিটি খাস জমি কিনা?

২. অর্পিত সম্পত্তিঃ
অনেক হিন্দু নাগরিক তাদের জমি-জমা পরিত্যাগ করে ভারতে চলে গেছেন এবং সেখানে নাগরিকত্ব লাভ করে বসবাস করেছেন। তাদের অনেকের ভূমি অর্পিত ও অনাবাসী সম্পত্তি (Vested and Non-Resident Property) হিসেবে সরকারের তালিকাভুক্ত হয়েছে এবং এগুলো সরকারের তত্ত্বাবধানে রয়েছে।
এসকল জমি সরকার ছাড়া অন্য কেও ক্রয় বিক্রয় করতে পারে না। এজন্য, যেকোন জমি ক্রয়ের আগে খোঁজ নিন এগুলো সরকারের তালিকাভুক্ত অর্পিত জমি কিনা?

৩. অধিগ্রহণকৃত জমি বা এরূপ সম্ভাবনার জমিঃ
রাষ্ট্র বা সরকার দেশের উন্নয়ন কর্মকাণ্ড যেমন শিল্প কারখানা, বিদ্যুৎ কেন্দ্র, রেলপথ, সড়ক বা সেতুর প্রবেশ পথ বা এ জাতীয় অন্য কিছুর জন্য জনগণের কোন ভূমি যদি দখল করে নেয় তাকে বলে “অধিগ্রহণ”। সরকার দেশের যেকোনো প্রান্ত থেকে যে কারো জমি অধিগ্রহণ করতে পারে।
অনেকেই সরকারের অধিগ্রহণকৃত জমি প্রতারণা করে বিক্রি করে। এজন্য, জমি ক্রয়ের পূর্বে ভূমি অফিসে খোঁজ নিয়ে জেনে নিন জমিটি সরকারের অধিগ্রহণকৃত জমি কিনা বা ভবিষ্যতে অধিগ্রহণ করার সম্ভবনা আছে কিনা।

৪. যাতায়াতের রাস্তা নেই এরূপ জমিঃ
যে জমিটি ক্রয় করবেন সেটির মৌজা ম্যাপ যাচাই করে বা সশরীরে উপস্থিত হয়ে খোঁজ নিন যে জমিটিতে যাতায়াতের রাস্তা আছে কিনা। যে জমিতে যাতায়াতের ব্যবস্থা নেই এমন জমি ভুলেও কিনবেন না।

৪. ইতোমধ্যে অন্যত্র বিক্রয়ের জন্য চুক্তিবদ্ধ কিনাঃ
অনেক বিক্রেতা একই জমি কয়েকজনের কাছে বিক্রি করেন। ফলে, আসল বিক্রেতার কাছ থেকে ক্রয় করার পরও জমির প্রকৃত মালিক হওয়া যায় না।
এজন্য জমি ক্রয় এর পূর্বে খোঁজ নিন বিক্রেতা পূর্বে অন্য কারো কাছে জমিটি বিক্রি করেছে কিনা বা বিক্রির জন্য বায়না চুক্তি করেছে কিনা।
সংশ্লিষ্ট রেজিস্ট্রি অফিসে গিয়ে খোঁজ নিন এর পূর্বে জমি হস্তান্তর জনিত কোন দলিল রেজিস্ট্রি হয়েছে কিনা।

৫. বন্ধকীকৃত জমিঃ
অনেক সময় জমি বিভিন্ন ব্যাংক বা প্রতিষ্ঠানে বন্ধক বা মর্টগেজ থাকে। এমন জমি কখনই ক্রয় করবেন না। কারণ বন্ধককৃত জমি ক্রয় – বিক্রয় সম্পূর্ণ বে-আইনী।

৬. কোন আদালতে মামলায় আবদ্ধ জমিঃ
অনেক সময় একই জমির মালিকানা নিয়ে আদালতে মামলা চলে। মামলা চলছে বা মামলা এখন নিষ্পত্তি হয়নি, এমন জমি কেনা উচিত নয়।

৭. বিরোধপূর্ণ জমিঃ
অনেক সময় ওয়ারিশসূত্রে জমির মালিক হলে ঠিকমত ওয়ারিশ সনদ বা বন্টননামা করা হয় না। এসব জমি নিয়ে ওয়ারিশদের মধ্যে বিরোধ চলে।
এসকল বিরোধপূর্ণ জমি কেনা কোনভাবেই উচিৎ নয়।
কৃষি জমি ক্রয়ের ক্ষেত্রে রেকর্ডীয় মালিকানায় অংশীদারগণ অগ্রক্রয়াধিকার প্রয়োগ করতে পারেন। সুতরাং অংশীদারদের সম্মতি সম্পর্কে নিশ্চিত হতে হবে

৮. দখলহীন জমিঃ
যেকোন জমির মালিকানার জন্য প্রয়োজন দলিল ও দখল। একটি ছাড়া অন্যটি অসম্পূর্ণ। এজন্য যিনি জমি বিক্রি করছেন জমিটি তার দখলে আছে কিনা জেনে নিন।
যদি দখলে না থাকে তবে এমন জমি ক্রয় করা থেকে বিরত থাকুন। দখলহীন মালিকদের জমি ক্রয় অত্যন্ত ঝুঁকিপূর্ণ। এতে জমি দখলের জন্য ঝগড়া, দাঙ্গা ফ্যাসাদ এবং মামলা মোকদ্দমায় জড়িত হওয়ার সম্ভাবনা থাকে।

৯. নাবালকের নামে জমিঃ
জমি যদি নাবালকের নামে থাকে, তবে সে জমি আদালত কর্তৃক নিযুক্ত অভিভাবক ছাড়া বিক্রি করা যায় না। সাধারনত ১৮ বছরের নিচে ব্যক্তিকে নাবালক বলা হয়।
এজন্য, অনেকেই এমন জমি কিনে যা ওয়ারিশসূত্রে কোন নাবালকের অংশ আছে। কিন্তু, নাবালক বড় হয়ে মামলা করলে জমিটি হাতছাড়া হয়ে যেতে পারে। এজন্য, এ ধরনের জমি কেনার ক্ষেত্রে সতর্ক হোন।

  1. Khas land
    When buying land, look for it so that it is not khas land. Lands that are directly owned by the government are called khas lands. Many times fraudulent forged documents are made and “khas land” is sold.
    The law states that if any land is vested in the hands of the government and is under the control of the government, those are khas lands. The government can settle these lands. Usually landless people get khas land officially. Therefore, before buying land, check the land office to see if the land is khas land?
  2. Vested property:
    Many Hindus have left their lands and moved to India and settled there. Many of their lands have been listed by the government as vested and non-residential properties and are under the supervision of the government.
    No one other than the government can buy and sell these lands. Therefore, before purchasing any land, find out whether these are government listed lands.
  3. Acquired land or land with such potential
    “Acquisition” is when the state or government occupies any land of the people for the development activities of the country such as industrial factories, power plants, railways, road or bridge entrances or anything like that. The government can acquire anyone’s land from any part of the country.
    Many sell government-acquired land fraudulently. Therefore, before purchasing land, check with the land office to find out if the land is government-acquired land or if it is likely to be acquired in the future.
  4. There is no road for such land
    Check the mouza map of the land you are going to buy or find out in person if there is a road in the land. Don’t forget to buy land that doesn’t have access to it.
  5. Whether already contracted for sale elsewhere
    Many sellers sell the same land to a few people. As a result, it is not possible to become the real owner of the land even after purchasing it from the original seller.

    Many times the land is mortgaged to various banks or institutions. Never buy such land. Because buying and selling mortgaged land is completely illegal.

Many times cases are filed in the court regarding the ownership of the same land. Land should not be bought if the case is ongoing or the case is not settled now.

. Disputed land:
In many cases, if the land is owned by the heirs, the inheritance certificate or distribution certificate is not issued properly. There is a dispute among the heirs over these lands.
There is no way to buy all these disputed lands.
In the case of purchase of agricultural land, the partners can exercise preferential rights in record ownership. So partners need to be sure about consent

. Unoccupied land:
Documents and possession required for ownership of any land. One is incomplete without the other. Therefore, the person who is selling the land should find out whether the land is in his possession.
If not occupied, refrain from purchasing such land. Purchasing land from unoccupied owners is extremely risky. It has the potential to be involved in land grabbing, riot facades and litigation.

  1. Land in the name of a minor
    If the land is in the name of a minor, that land cannot be sold without a guardian appointed by the court. A person under the age of 18 is usually called a minor.
    Because of this, many people buy land that is inherited by a minor. However, if the minor grows up and files a case, the land may be lost. Therefore, be careful when buying such land.
