(ঢাকা, বুধবার, ১৩ এপ্রিল ২০২২) নাগরিক ও অংশীজনের মতামতের ভিত্তিতে তাৎক্ষনিক শাস্তির বিধান রেখে ‘ভূমি অপরাধ প্রতিরোধ ও প্রতিকার আইন, ২০২২’-এর খসড়া মন্ত্রিপরিষদে অনুমোদনের জন্য প্রেরণের সুপারিশ করা হয়েছে। এই সুপারিশের সাথে সহমত প্রকাশ করে ভূমিমন্ত্রী সাইফুজ্জামান চৌধুরী বলেন, মামলার দ্রুত নিষ্পত্তি করে ক্ষতিগ্রস্ত পক্ষের দ্রুত আইনি প্রতিকার বা ন্যায়সঙ্গত সমাধানের ব্যবস্থা করা সুবিচার নিশ্চিত করার জন্য অপরিহার্য।

আজ বুধবার ভূমি মন্ত্রণালয়ের সভাকক্ষে ভূমি মন্ত্রণালয় কর্তৃক প্রস্তাবিত ‘ভূমি অপরাধ প্রতিরোধ ও প্রতিকার আইন, ২০২২’-এর খসড়া চূড়ান্তকরণের লক্ষ্যে ভূমিমন্ত্রী সাইফুজ্জামান চৌধুরীর সভাপতিত্বে অনুষ্ঠিত আন্ত:মন্ত্রণালয় সভার আলোচনায় অনেকগুলো সুপারিশের সাথে উপর্যুক্ত সুপারিশও উঠে আসে। ভূমি সচিব মোঃ মোস্তাফিজুর রহমান পিএএ এই সময় উপস্থিত ছিলেন।

ভূমিমন্ত্রী সাইফুজ্জামান চৌধুরী সভায় বক্তব্য রাখার সময় আরও বলেন, প্রকৃত মালিকদের স্বত্ব ও দখলভোগ নিশ্চিত করা, অবৈধভাবে ভূমির দখল রোধ ও সংশ্লিষ্ট অপরাধ প্রতিরোধ ও দ্রুত প্রতিকার নিশ্চিত করা ভূমি অপরাধ প্রতিরোধ ও প্রতিকার আইনের অন্যতম উদ্দেশ্য।
ভূমিমন্ত্রী বলেন, নাগরিকের কল্যাণের জন্যই আইন তৈরি করা হয়। আমাদের মূল্যবান ভূ-সম্পদের রক্ষা করার প্রথম দায়িত্ব আমাদের নিজেদের। এজন্য সংশ্লিষ্ট আইন সম্পর্কেও আমাদের সবার স্বচ্ছ ধারনা থাকা উচিত। দেশের নাগরিকগণ যেন আইন-সংশ্লিষ্ট বিষয়াদির তথ্য সঠিকভাবে পান সেজন্যও কাজ করে যেতে হবে।

সভায় সংশ্লিষ্ট আইনের উপর নাগরিক ও অংশীজন থেকে প্রাপ্ত মতামতের উপর ফলপ্রসূ আলোচনা হয়। আলোচনার মাধ্যমে প্রাপ্ত সুপারিশগুলোর ভিত্তিতে প্রাথমিক খসড়াটি প্রয়োজনীয় সংশোধন করে সংশোধিত খসড়া প্রথমে জনপ্রশাসন মন্ত্রণালয়ে ভাষা প্রমিতীকরণের জন্য পাঠানো হবে। উক্ত প্রমিতীকৃত খসড়াটি পরবর্তীতে মন্ত্রিপরিষদ বিভাগে পাঠানোর মধ্যে দিয়ে আইন প্রণয়নের পরবর্তী ধাপ শুরু হবে। উল্লেখ্য, এই বছরের জানুয়ারী মাসের ১৯ তারিখে ভূমি অপরাধ প্রতিরোধ ও প্রতিকার আইন প্রণয়নের লক্ষ্যে এর প্রাথমিক খসড়া (বিল) ভূমি মন্ত্রণালয়ের ওয়েবসাইটে সবার মতামতের জন্য প্রকাশ করা হয়েছিল।
সভায় জানানো হয়, মতামতের জন্য উন্মুক্ত হওয়ার পর থেকে দেশের নাগরিক ও অংশীজন থেকে অভূতপূর্ব সাড়া পাওয়া যায়। প্রতিষ্ঠান ও ব্যক্তি পর্যায় হতে আড়াইশোর অধিক সুস্পষ্ট শ্রেণীগত মতামত পাওয়া গিয়েছে। এছাড়া ব্যক্তি পর্যায়ে বিভিন্ন স্থান থেকে প্রাপ্ত সংক্ষিপ্ত মতামত হাজারেরও অধিক।

এসব মতামতের ভিত্তিতে যেসব বিষয়ে আলোচনা হয়, তার মধ্যে আছে ব্যক্তি জমি, খাসজমি এবং সরকারি প্রতিষ্ঠানের জমি দখল সংশ্লিষ্ট অপরাধ ও এর প্রতিকার, প্রতিরোধ, শাস্তির বিভিন্ন দিক এবং ভূমির অবৈধ ও যথেচ্ছ ব্যবহারে আর্থসামাজিক ও পরিবেশগত প্রভাব।

এছাড়া, ভূ-সম্পদ সম্পর্কিত ২২ ধরনের/শ্রেণির চিহ্নিত অপরাধের ধরণ/শ্রেণি কমিয়ে আনারও সুপারিশ করা হয় সভায়। সংশ্লিষ্টরা মনে করেন, একই ধরণের অপরাধগুলো সার্বিকভাবে একই ধারায় নিয়ে আসলে আইনের কলেবর আরও ছোটো হবে। এছাড়া কোনো কোনো অপরাধে জেল-জরিমানা দুটোরই বিধান রাখার সুপারিশ করা হয়। সভায় বেশ কয়েকজন আলোচকবৃন্দ প্রচলিত কাঠামোর মধ্যে আইনের খসড়া তৈরি থেকে বের হয়ে এসে প্রযোজ্য ক্ষেত্রে যুগোপযোগী কাঠামো ব্যবহার করেও আইনের খসড়া প্রস্তুতের ওপর জোর দেন।

লেজিসলেটিভ ও সংসদ বিষয়ক বিভাগের সাবেক সিনিয়র সচিব মোহাম্মদ শহিদুল হক, ভূমি সংস্কার বোর্ডের চেয়ারম্যান সোলেমান খান, ভূমি আপীল বোর্ডের চেয়ারম্যান ড. অমিতাভ সরকার, ভূমি রেকর্ড ও জরিপ অধিদপ্তরের মহাপরিচালক মোঃ মোয়াজ্জেম হোসেন, ভূমি মন্ত্রণালয়ের যুগ্মসচিব (আইন) মোঃ খলিলুর রহমান সহ মন্ত্রিপরিষদ বিভাগ, জনপ্রশাসন মন্ত্রণালয়, জননিরাপত্তা বিভাগ, স্থানীয় সরকার বিভাগ, অর্থ বিভাগ, পানি সম্পদ মন্ত্রণালয়, গৃহায়ন ও গণপূর্ত মন্ত্রণালয়, আইন ও বিচার বিভাগ, লেজিসলেটিভ ও সংসদ বিষয়ক বিভাগ, কৃষি মন্ত্রণালয়, সুরক্ষা ও সেবা বিভাগ, নৌপরিবহন মন্ত্রণালয়, শিক্ষা মন্ত্রণালয়, পরিবেশ ও জলবায়ু পরিবর্তন মন্ত্রণালয়, সড়ক পরিবহন ও মহাসড়ক বিভাগ, প্রতিরক্ষা মন্ত্রণালয়, পার্বত্য চট্টগ্রাম বিষয়ক মন্ত্রণালয়, বেসামরিক বিমান পরিবহন ও পর্যটন মন্ত্রণালয়, মৎস্য ও প্রাণিসম্পদ মন্ত্রণালয়, সেতু বিভাগ, শিল্প মন্ত্রণালয়, রেলপথ বিভাগ, বাংলাদেশ পুলিশ এবং ভূমি মন্ত্রণালয়ের সংশ্লিষ্ট কর্মকর্তারা সভায় অন্যান্যদের মধ্যে উপস্থিত ছিলেন।

//Providing speedy legal redress or equitable relief is imperative to ensure justice – Land Minister//

Based on the opinion of citizens and stakeholders, the draft ‘‘Land Crime Prevention and Redress Act, 2022’’ has been recommended to be sent to the Cabinet for approval with the provision of instant punishment. Concurring with the recommendation, Land Minister Saifuzzaman Chowdhury said it was essential to provide speedy legal redress or equitable relief to the injured party by speedy disposal of cases is imperative to ensure justice.

Along with many of the recommendations, the aforementioned recommendation also came up at an inter-ministerial meeting chaired by Land Minister Saifuzzaman Chowdhury aimed at finalizing the draft of the land ministry proposed ‘‘Land Crime Prevention and Redress Act, 2022’’ held today Wednesday in the meeting room of the land ministry. Land Secretary Mohammad Mustafizur Rahman PAA was present.

Addressing the meeting, Land Minister Saifuzzaman Chowdhury further said that one of the objectives of the Land Crime Prevention and Redress Act is to ensure ownership and possession of real owners, prevent the illegal occupation of land and prevent related crimes and ensure speedy redressal of crimes.

The land minister said the law is enacted for the benefit of the citizens. Our first responsibility is to protect our priced land property. Therefore, we should all have a clear idea about the relevant laws. It is also important to ensure that the citizens of the country get proper information on legal issues.

The meeting had fruitful discussions on the views of citizens and stakeholders on the draft of the law. Based on the recommendations received through discussion, the preliminary draft will be amended as necessary and the revised draft will first be sent to the Ministry of Public Administration for language standardization. The next phase of legislation will begin by sending the standardized draft to the Cabinet Division later. On January 19 this year, its primary draft (bill) aimed at enacting the Land Crime Prevention and Redress Act was published on the website of the Ministry of Land for everyone’s opinion.

It was informed at the meeting that there was an unprecedented response from the citizens and stakeholders of the country since it was opened for opinion. More than two hundred and fifty categorical opinions have been received from the organization and individual levels. In addition, there are more than a thousand brief comments from different places from the individuals.
Among the issues discussed based on these views are the crimes related to illegal occupation of private land, Khas land, and government land and various aspects of its redress, prevention, and punishment, as well as the socio-economic and environmental impact of illegal and arbitrary use of land.

Apart from this, it was also recommended to reduce the type/class of identified crimes of 22 types/classes related to land resources. Those concerned believe that bringing the same overlapping crimes under the same section will make the law smart. Apart from this, it was recommended to keep both provision of jail and fine for some offenses. At the meeting, several participants opined on the drafting of law using an up-to-date framework where applicable instead of a conventional framework.

Former Senior Secretary of the Legislative and Parliamentary Affairs Division Mohammad Shahidul Haque, Chairman of the Land Reform Board Soleman Khan, Chairman of the Land Appeal Board Dr. Amitabh Sarker, Director General of Land Records and Survey Department MD. Moazzem Hossain, Joint Secretary (Law) of the Ministry of Land Md. Khalilur Rahman along with the officers from Cabinet Division, Ministry of Public Administration, Public Security Division, Local Government Division, Finance Division, Ministry of Water Resources, Ministry of Housing and Public Works, Law & Justice Division, Legislative and Parliamentary Affairs Division, Ministry of Agriculture, Security Service Division, Ministry of Shipping, Ministry of Education, Ministry of Environment, Forest and Climate Change, Road Transport and Highways Division, Ministry of Defense, Ministry of Chittagong Hill Tracts, Ministry of Civil Aviation and Tourism, Ministry of Fisheries and Livestock, Bridges Division, Ministry of Industries, Ministry of Railways, Bangladesh Police and the Ministry of Land were present at the meeting, among others.
